Remedial - Steps under Consumer Protection Act, 2019

Under the Act, consumers can claim damages (compensation) for defective goods, deficient services, unfair trade practices, misleading advertisements, and product liability issues.


Steps to Claim Damages:

  • A. Before filing a complaint, send a written notice to the seller/service provider, explaining the issue and demanding compensation.

  • B. This may lead to an out-of-court settlement.
  • A. If the issue is not resolved, you can file a formal complaint in the relevant Consumer Disputes Redressal Commission (CDRC) based on the claim amount:

  • A. If required, attend hearings before the commission.

  • B. The commission may order the opposite party to compensate, refund, or replace goods/services.

  • If the seller/service provider does not comply, the consumer can approach the commission to enforce the order.
