Appeals Under the Consumer Protection Act, 2019
If a consumer is not satisfied with the decision of a consumer commission, they have the right to file an appeal to a higher authority. The appeal must be filed within a specified time limit from the date of the order.
Hierarchy & Time Limits
- A. If unsatisfied with the District Consumer Disputes Redressal Commission (DCDRC) order, appeal to the State Consumer Disputes Redressal Commission (SCDRC).
- B. Time Limit: 45 days from the date of the District Commission’s order.
- C. Court Fee: As per the amount claimed
- A. If unsatisfied with the State Commission order, appeal to the National Consumer Disputes Redressal Commission (NCDRC).
- B. Time Limit: 30 days from the date of the State Commission’s order.
- A. If unsatisfied with the National Commission order, appeal to the Supreme Court of India.
- B. Time Limit: 30 days from the date of the National Commission’s order.
- 1. There is a legal error or violation of rights in the previous judgment.
- 2. The compensation awarded is inadequate.
- 3. There was procedural irregularity or bias in the decision.
- 4. The evidence was not properly considered.
