Consumer Protection Act, 2019

The Act is the primary law in India that safeguards the rights of consumers. It replaced the Consumer Protection Act, 1986, introducing new provisions to address modern consumer issues, including e-commerce and misleading advertisements.


Entities covered

Under the Consumer Protection Act, 2019 (India), a consumer is defined under Section 2(7) as a person who, Buys goods (or) Avails services for a consideration (paid, partly paid, or promised to be paid), including through online or offline transactions, teleshopping, direct selling, or electronic means.

  • A. Manufacturers, wholesalers, and retailers supplying goods to consumers

  • B. Service providers like banks, insurance companies, telecom operators, healthcare providers, e-commerce platforms, and travel agencies
  • A. Online platforms like Amazon, Flipkart, Zomato, and Swiggy.

  • B. It includes sellers operating via social media or independent websites.

  • C. Platforms are responsible for ensuring fair trade practices.
  • A. Any entity involved in the manufacturing process, even if they are not selling directly to consumers

  • B. Can be held liable for defective products under product liability provisions.
  • A. Misleading advertisements can lead to action against both the advertiser and celebrity endorsers.
